We generally do not include business contact information as Personal Information when it is used to contact you in your professional capacity or regarding your business.

Indirect Collection
Mapgears primarily collects personal information directly from the individual concerned. However, in certain cases, Mapgears may also collect personal information from third parties, such as partners, suppliers, corporate clients or public bodies, when this is required to provide its services, fulfill its legal or contractual obligations, or when the individual concerned has consented to such collection. Any indirect collection is carried out in accordance with this Policy and applicable legislation.
User of our web or mobile applications
You are a user of our web or mobile applications when you choose to provide us with your Personal Information through the creation and use of your account on our various applications or when you are an end user associated with the account of one of our corporate clients.

Corporate Client, Supplier, Partner
You are a corporate client when you act as a representative of a company or organization that benefits from the Services offered by Mapgears and its subsidiaries or any other type of specific Services offered to businesses. In this situation, Mapgears does not have a direct relationship with the end users of the Services.
This is why we require our corporate clients to ensure they have obtained all mandatory consents from their end users. The end user should in particular have consented to having their Personal Information managed by Mapgears in accordance with this Privacy Policy. We also ask our clients to provide the legally required notices to end users and to ensure that the use, collection or disclosure of Personal Information between Mapgears and the corporate client is authorized.
You are a supplier or partner when you enter into a partnership agreement or a Services agreement with Mapgears.
A. What Personal Information do we collect?
Mapgears does not consider the business contact information of a corporate client, supplier or partner to be Personal Information, to the extent that such information is used to communicate with these individuals in the context of their duties or for the operation of their business.
In certain cases, we may collect other Personal Information about our corporate clients, suppliers and partners that will be used for purposes other than contacting you in a business context. In these rare cases, we will ask for your consent to do so.

Personal Information of Minors
If a parent or guardian discovers that their minor child under the age of 14 has provided us with Personal Information without us having obtained the appropriate consent, such parent or guardian has the right, upon request, to access the Personal Information provided by the child and/or to require that it be deleted from our records. In such case, we ask the parent or guardian of the child to contact us at the contact information indicated in section 6.
Basis for Processing Personal Information
When we collect your Personal Information, we ensure that we only collect information necessary to achieve one of our objectives, which will have been previously disclosed to you, for example in this Policy. We use Personal Information in accordance with the privacy laws that apply to our activities.

Your Consent
As required by the applicable privacy laws, Mapgears collects most of your Personal Information based on your voluntary consent, favouring collection directly from you.
Mapgears is committed to obtaining your explicit consent for the collection of any sensitive Personal Information. You may withdraw your consent at any time, without affecting the lawfulness of prior processing, by contacting the Privacy Officer at the contact information in section 6.
Other Permitted Legal Basis, such as Performance of our Contracts
As permitted by applicable privacy laws, Mapgears may collect Personal Information without your explicit consent, for example to comply with obligations under applicable laws or to perform our contracts.

Your Personal Information will not be sold to third parties.
We share your Personal Information with third parties for (i) achieving our mandate and objectives, (ii) responding to requirements or requests made pursuant to applicable laws, (iii) for any purpose required or authorized by law.
Most of the time, you have already consented to such sharing, for example by accepting the consent presented to you when creating your account on one of our applications. Sometimes applicable laws also allow us to share your Personal Information with third parties without your consent, in specific cases.

In such cases, we implement reasonable contractual and technical safeguards to ensure that these third parties keep strictly confidential all the Personal Information they process.

Your Personal Information may be disclosed and retained outside of your province, state, territory or country of residence. Our business partners and service providers are sometimes located in Canada or in other countries. Please note that we have contractual agreements with these third parties and suppliers to ensure that your Personal Information is processed in accordance with the laws applicable to us. Where applicable, we conduct Privacy Impact Assessments prior to a transfer of Personal Information to another jurisdiction, for example outside of Quebec.
Retention and Destruction of Personal Information
Mapgears will retain your Personal Information only for the period required to achieve the purposes for which they were collected, in accordance with our internal document retention policies, to comply with applicable legal, tax or regulatory requirements, or until you ask us to destroy them. After such period, any relevant Personal Information held by Mapgears will be destroyed, deleted or anonymized.
3. Security
The security of your Personal Information is a priority for us. Our security measures include, without limitation, a privacy incident management plan including notification to authorities and affected individuals in the event of a serious risk.
Our employees and suppliers are informed of the confidential nature of the Personal Information collected and are made aware of appropriate security measures to prevent unauthorized access to your Personal Information. In addition, our service providers commit to us to use reasonable security measures to preserve the integrity and confidentiality of your Personal Information.
We maintain our services and all associated data with technical, administrative and physical safeguards to protect you against loss, unauthorized access, destruction, misuse, modification and improper disclosure of your Personal Information. These safeguards vary according to the sensitivity of the data we hold and are based on industry best practices.
In the event of a privacy incident presenting a serious risk of harm, Mapgears implements the incident management plan including documentation, notification to competent authorities and, where applicable, to the affected individuals.
Despite the measures described above, no method of data transmission or storage is perfectly secure or error-free. Unfortunately, we cannot guarantee absolute security.

4. Your Rights Regarding your Personal Information
Depending on applicable laws, where you reside and how you interact with us, certain rights may be granted to you regarding the Personal Information we hold about you.
In the case of corporate clients, since we do not have a direct business relationship with the end user, Mapgears will generally refer end user requests for access to information, correction of Personal Information or other such requests to the corporate client, unless Mapgears has contractually committed to doing so with the client, as part of its service delivery.
4.1. Your Rights Regarding your Personal Information
You may file a complaint with the Privacy Officer of Mapgears if you are not satisfied with our management of your Personal Information or compliance with this Policy. You may contact the Privacy Officer at the contact information in section 6.
You are also permitted by law to file a complaint with a Privacy Commissioner or any other competent supervisory authority for the protection of Personal Information.
4.2. Exercising your Rights
You may yourself review, correct, update, modify or delete certain Personal Information you have provided to us by using your account. Simply log in to your account and make the changes.
You may also exercise the rights listed above by making a written request to our Privacy Officer. The latter will be able to assist you in your process, if needed.
For your protection, we may need to verify your identity before processing your request. Depending on applicable laws, we will inform you of the procedure to follow, the processing time and the information required, where applicable. We attempt to respond to requests promptly, usually within 30 days.
In the context of the processing activities covered by this Policy, Mapgears does not make decisions based solely on automated processing that produces legal effects or similarly significant effects.
4.3. Your Choices Regarding our Use and Disclosure of Personal Information

Mapgears is committed to providing an estimated response time and to handling any complaint within a maximum of 30 days. 7. Cookies
A cookie (hereinafter: “Cookie”) is a small text file that is stored in a dedicated location on your computer, mobile device, tablet or any other device when you use your browser to visit an online service. We review the Policy from time to time to comply with applicable laws or in the event of changes to our operations or practices.
If we were to update the Policy significantly, we will notify you by sending a notice, either on your account, on our Sites, by email or by any other means we deem appropriate. This policy does not apply to third-party websites, applications or other services accessible through our products or services. Mapgears is not responsible for the privacy practices of these third-party platforms, sites or applications.
